2.1       Personal Data You Provide To Us On Our Site. 2.3       Personal Data You Provide in and Through Our Social Media Commerce Integrations. If you purchase a product through our social media commerce solution that enables purchases of our customers’ products in and through social media, we collect the following Personal Data about you:

2.4       Information Collected Automatically. Certain information is collected automatically as users interact with our Site or other web pages that embed DFW technology such as chat. We have a legitimate interest in using such information to assist in log-in, systems administration purposes, information security and abuse prevention and detection, to track user trends, and to analyze the effectiveness of our Site. Some of our service providers may use cookies or other methods to gather information regarding your use of our Site. 3.3       Hotjar Software Tool. We use Hotjar on our Site to help us helps us better understand our users’ experience and this enables us to build and maintain our service with user feedback. Hotjar stores the information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. 3.4       Personyze Software Tool We use Personyze in order to better understand our users’ needs and to optimize our service and customer experience. Personyze stores data in a pseudonymized user profile. Neither Personyze nor we will ever use this information to identify individual users or to match it with further data on any individual user. 3.5       Leadfeeder Software Tool We use Leadfeeder to better understand the visitors on our website and enrich the data. Leadfeeder visualizes this information by correlating the company IP-address from visitors on our website with other publicly accessible information, such as Linkedln accounts. Leadfeeder does not capture or track individual (personal) data, but merely processes the company data and combines it with information from publicly accessible data sources. 3.6       Intercom Software Tool We utilize Intercom to collect visitors data for analytics purposes or use our product. As a data processor acting on our behalf, Intercom analyzes visitors’ use of our website and/or product and tracks our relationship by way of cookies and similar technologies so that we can improve our services. 4. The Purposes For Which We Use Personal Data.

If you submit or we collect Personal Data through our Site, then such Personal Data may be used in the following ways: (i) to provide, analyze, administer, and improve our Site and services, (ii) to contact you in connection with our Site and certain services, notifications, events, programs, or offerings that you may have registered for, (iii) to send you updates and promotional materials that you have registered for, (iv) to identify and authenticate your access to the parts of our Site and services that you are authorized to access; (v) for recruiting and human resources administration purposes, and (vi) to protect our rights and/or our property and to ensure the technical functionality and security of our Site.

 

5. How We Disclose Personal Data.

We do not sell, lease, rent or otherwise disclose the Personal Data collected from our Site to third parties unless otherwise stated below or with your consent.

5.1       Our Third-Party Service Providers. We transfer Personal Data to our third-party service providers to perform tasks on our behalf and to assist us in providing our Site. Notwithstanding the foregoing, we will comply with applicable laws regarding Personal Data transfers as well as any transfer restriction that is specified in an agreement between DFW and a customer.

If you purchase or specifically express interest in a jointly offered product or service from us, we may share Personal Data collected in connection with your purchase or expression of interest with our partner(s). We do not control our business partners’ use of Personal Data we collect, and their use of the information will be in accordance with their own privacy policies.

5.3       In the Event of Merger, Sale, or Change of Control. We may transfer or assign this Privacy Policy and any Personal Data to a third-party entity that acquires or is merged with as part of a merger, acquisition, sale, or other change of control.

5.4       Other Disclosures. We may disclose Personal Data about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process, or governmental request; (ii) enforce our Terms of Use, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property, or safety of DFW, our users, or the public.

 

6. Retention of Personal Data.

We reserve the right to retain any Personal Data as long as the information is needed to: (i) fulfill the purposes that are described in Section 4 (The Purposes For Which We Use Personal Data), and (ii) comply with applicable law.

 

7. Your Rights.

7.1       Personal Data. If you have an account on our Site, we provide the ability to access, correct, or delete certain categories of Personal Data through your account.

7.2       Opting Out of Promotional Emails. You may choose not to receive future promotional or advertising emails from us by selecting an unsubscribe link at the bottom of each email that you receive from us. Additionally, you may send a request specifying your communications preferences to privacy@cart.com. Customers cannot opt out of receiving transactional emails related to their account with us or our services. Please note that even if you opt out of receiving the foregoing emails, we may still send a response to any request you submit to us as well as administrative, maintenance, and operational emails.

 

8. Personal Data Transferred from the EEA or Switzerland to The United States.

If you are visiting the Site outside of the United States, please be aware that you are sending information to the United States where. That information may then be transferred within the United States or back out of the United States to other countries outside of your country of residence.  These countries (including the United States) may not have data protection laws as comprehensive or protective as those in your country of residence. Such transfers are made using commercially acceptable safeguards and appropriate additional measures, such as the European Union Standard Contractual Clauses for Controller-to-Controller and Controller-to-Processor Transfers. The security of Personal Data is important to us. We follow generally accepted appropriate technical, security, and organizational measures to protect the Personal Data submitted to us, both during transmission and in storage. Your Personal Data is stored and processed securely using Secured Socket Layer (“SSL”) technology and access is restricted to authorized personnel. However, no method of transmission over the Internet or method of electronic storage is 100 percent secure. Therefore, while we strive to use commercially reasonable means to protect Personal Data, we cannot guarantee its absolute security.

 

10. Children's Privacy.

Because of the nature of our business, our Site is not intended for use by children under the age of 18. If you are not yet 18 years old or have not reached the age of majority in the state or jurisdiction in which you reside, you may not use our Site. Accordingly, we do not intend to collect Personal Data from anyone we know to be under 18 years of age.

 

11. How We Respond to Do Not Track Signals.

DFW does not track Site users over time and across third party websites to provide targeted advertising. Accordingly, we do not currently respond or take any action with respect to web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Data about an individual consumer's online activities over time and across third-party web sites or online services.
